Terms and Conditions
1. Harvey Norman Floor Staff / Sales Representatives that sell any ACT! by Sage Standard product from the following products listed below in one transaction from a Harvey Norman store between 01.02.2009 and 31.03.2009 will receive 1 (one) Nintendo Wii Console and comes bundled with Wii Sports. Wii Sports includes 5 games: Golf, Baseball, Bowling, Tennis and Boxing. The Wii console comes with the following accessories: One Wii Remote, One Wii Nunchuk, Console stand, Sensor bar, AC adapter power supply and AV cable. The Nintendo Wii Sports Pack is up to the value of $500.
2. Answer the 5 True or False questions on the Scholastic Loves ACT! webpage and send your answers on an email to charley.coates@sage.com with the subject line: Scholastic loves ACT!. Complete your Full Name, Contact Phone Number, Email Address and Home Mailing Address on the email.
As part of these terms and conditions you are required to keep a sent copy of your email answer until the Nintendo Wii draw has taken place and a winner has been announced. If you enter multiple times, you may be required to provide sent email copies for all entries. Failure to provide these to the Promoter upon request may, at the Promoter's discretion, result in an invalid entry (and, at the Promoter's discretion, in all of the entrant's entries being invalid).
3. Entries must be received by Charley Coates by 31.03.2009. The draw will take place at the office of the Promoter and a winner will be notified by phone and email. All entrants will be notified as to the winner of the Nintendo Wii by email after the winner has been notified.
Conditions of entry
1. Information on how to enter and prizes form part of these Conditions of Entry. Participating in this promotion is deemed acceptance of these Conditions of Entry.
2. Entry is only open to Harvey Norman employees in Australia. Employees of the Promoter, Scholastic and their agencies associated with this promotion and the immediate family of these people are ineligible to enter.
3. The Promoter reserves the right, at any time during or after the closing date of the promotion, to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Multiple entries are permitted.
5. The Promoter is not responsible for receipt of incomplete or incomprehensible entries. All such entries will be deemed invalid. No responsibility accepted for late, lost or misdirected entries. Any entry that does not comply with these terms and conditions will be invalid.
7. Promotion commences 01.02.2009 and promotion ends 31.03.2009 (“Promotional Period”). Last email received on 31.03.2009.
8. The Promoter accepts no responsibility for any variation in the prize value. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
9. All prize values are in Australian dollars and include GST.
10. In the event that the prize is not available despite the Promoter’s reasonable endeavours to provide the prize, the Promoter reserves the right to substitute prize(s) to the same and equal recommended retail value and/or specification.
11. The Promoter reserves the right to request winners to provide proof of identity as per the details entered on the email. Any contact details entered incorrectly shall invalidate the entry at the discretion of the Promoter. Identification considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry, which is not in accordance with these Conditions of Entry and the prize will be redrawn in accordance with these Terms and Conditions.
12. The Promoter reserve the right in their sole discretion to disqualify any individual who tampers with the entry process, and, to cancel, terminate, modify or suspend the competition, if for any reason this competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition.
13. To the full extent permitted by law, the Promoter and Scholastic exclude all liability however so arising (including all liability arising from negligence on the part of the Promoter or Scholastic or their officers, employees or agents) for any loss, damage, personal injury or death whether direct, indirect, special or consequential which is suffered or sustained, by the entrants, arising in any way out of or in connection with the promotion, including but not limited to, accepting or using a prize.
14. The Promoter accepts no responsibility for any taxation consequences. Where the operation of the competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
15. All entries remain the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. If entrants indicate their consent at the point of entry, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. A request to access, update or correct any information should be directed to the Promoters at their address set out below.
